Buying a unit, apartment or townhouse is not the same as buying a freestanding house, because you are buying into an owners corporation as well as a property. The owners corporation is the body that manages the common property in a strata scheme, and it carries levies, by-laws, records and sometimes liabilities that a standard house contract does not. The extra work in a strata purchase centres on the owners corporation. The conveyancer or solicitor we refer you to reviews the strata records, the levies and any special levies, the capital works fund (formerly the sinking fund) and the administrative fund, the by-laws that govern what owners can and cannot do, and the meeting minutes that may reveal disputes, planned works or building defects. These records can change the real cost of owning the unit and occasionally reveal problems that affect whether you should proceed.
Strata properties also bring extra disclosure into the contract for sale. The prescribed documents a NSW vendor must include, together with the strata information a buyer needs, are checked by the conveyancer against the owners corporation records, so you understand the levies and obligations before you commit.
