How the conveyancing works in NSW

Buying a unit, apartment or townhouse is not the same as buying a freestanding house, because you are buying into an owners corporation as well as a property. The owners corporation is the body that manages the common property in a strata scheme, and it carries levies, by-laws, records and sometimes liabilities that a standard house contract does not. Sydney Conveyancers, a referral service rather than a law firm, connects you with licensed conveyancers and solicitors who handle strata transactions in NSW.

The extra work in a strata purchase centres on the owners corporation. The conveyancer or solicitor we refer you to reviews the strata records, the levies and any special levies, the capital works fund (formerly the sinking fund) and the administrative fund, the by-laws that govern what owners can and cannot do, and the meeting minutes that may reveal disputes, planned works or building defects. These records can change the real cost of owning the unit and occasionally reveal problems that affect whether you should proceed.

Strata properties also bring extra disclosure into the contract for sale. The prescribed documents a NSW vendor must include, together with the strata information a buyer needs, are checked by the conveyancer against the owners corporation records, so you understand the levies and obligations before you commit. A strata records inspection is often arranged as part of this work.

Beyond the strata-specific review, the usual conveyancing steps apply: the conveyancer reviews the contract, runs the title and property searches, calculates transfer duty (the NSW state tax on a property purchase, formerly stamp duty, administered by Revenue NSW), liaises with your lender, and manages settlement through PEXA, the online platform used to lodge documents and transfer ownership. They also calculate the settlement adjustments, including the apportioning of strata levies between seller and buyer.

This service suits buyers and sellers of units, apartments and townhouses right across Sydney, and it is especially relevant in suburbs such as the CBD, Pyrmont, Chatswood and Parramatta where strata stock dominates. On cost, many conveyancers in our network offer a fixed professional fee for a routine unit purchase or sale, with government charges, search fees and other disbursements confirmed separately in writing. We are a referral network and never set or charge the fee.

If you are buying or selling a Sydney unit or apartment, share a few details and we will connect you with a licensed conveyancer or solicitor, usually within one business day.

Unit and Strata Conveyancing: common questions

Quick, factual answers on how this service works in NSW.

What extra checks apply when buying a unit?
The conveyancer reviews the strata records, levies and any special levies, the capital works and administrative funds, the by-laws and the minutes that may reveal disputes or planned works. These can change the real cost of owning the unit.
What is an owners corporation?
The owners corporation is the body that manages the common property in a strata scheme. It sets levies, makes by-laws and keeps records. When you buy a unit you buy into the owners corporation as well as the property.
What is the capital works fund?
The capital works fund, formerly called the sinking fund, is money the owners corporation sets aside for major repairs and capital expenses. The conveyancer checks its balance and any special levies, because these affect the real cost of owning the unit.
How much does unit conveyancing cost?
Many conveyancers in our network offer a fixed professional fee for a routine unit purchase or sale. Government charges, search fees and other disbursements are additional and confirmed separately in writing.
